Online Advertising Regulations and Legalities

New MHRA, CAP and ASA advertising regulations.

The Medicines and Healthcare products Regulatory Agency (MHRA), Committee of Advertising Practice (CAP) and Advertising Standards Authority (ASA) have released new regulations in relation to the online advertising of herbal medicines and product claims.

The MHRA's regulations concern helping those in the herbal medicine sector to understand and comply with the Traditional Herbal Medicines Registration Scheme (THMRS), as required by Directive 2004/24/EC on Traditional Herbal Medicinal Products.

The CAP and ASA regulations concern false advertising claims and ensuring consumers are protected from misleading advertising and unendorsable claims made by advertisers.

Regarding the false advertising claims in the herbal medicine sector, the MHRA states "...the public can be assured that herbal medicines registered under the Traditional Herbal Registration scheme meet the assured standards of safety and manufacture, and that they come with authorised information for consumers about the safe use of the product.", read about the Traditional Herbal Medicines Registration Scheme.

On 1st March 2011, "the remit of the Advertising Standards Authority (ASA) was extended significantly to deliver more comprehensive consumer protection online". Read the extended ASA remit.

In line with this, "the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (the CAP Code) now applies in full to marketing messages online, including the rules relating to misleading advertising, social responsibility and the protection of children".
